Challenge
A third party in Ukraine had registered a trademark reproducing the client’s stage name in bad faith, covering goods in Class 25 (apparel) and services in Class 35 (retail) of the Nice Classification. The registration obstructed the client’s brand protection in Ukraine and risked unauthorized exploitation of the celebrity’s reputation.
Our approach
We filed a cancellation lawsuit on behalf of the performer and her company, seeking to invalidate the registration for all goods and services. During the proceedings, we achieved a position where the defendant fully acknowledged the claim and filed a statement to that effect with the court.
Outcome
On September 4, 2024, the court granted the claim. The trademark registration was cancelled in full. The defendant’s complete acknowledgment of the claim confirmed the indisputable nature of the client’s rights and secured definitive protection of the stage name in Ukraine.
