The new Regulations of the Appeals Chamber of the Ukrainian National Office for Intellectual Property and Innovations (the Ukrainian IP Office / UANIPIO) entered into force on February 9, 2024.
These Regulations were developed to determine the powers of the Appeals Chamber, the Chamber’s procedure for consideration of oppositions against decisions of the UANIPIO regarding obtaining rights to IP objects (patents, trademarks, designs), claims for the invalidation of rights to IP objects, applications for recognition of a trademark as well known in Ukraine, and the resolution of other issues within its competence.
Currently, organizational and legal measures are being taken to form the personnel of the Appeals Chamber.
After the approval of the personnel of the Appeals Chamber and its approval by the order of the Ukrainian IP Office, the work of the Appeals Chamber will be resumed.
Key provisions of the new Regulations of the Appeals Chamber of the Ukrainian IP Office:
• the possibility of consideration of the oppositions against decisions regarding the acquisition of rights to intellectual property objects is provided for in a simplified procedure;
• the possibility of conducting mediation at any stage of consideration of the opposition or appeal claim;
• the possibility of creating a personal account in the Electronic Interaction System of the Ukrainian IP Office for the participants to submit documents in electronic form;
• the possibility of storing video and audio recordings of video conferences in the Electronic Interaction System of the Ukrainian IP Office;
• the procedure for consideration of appeal claims on recognition of rights to intellectual property objects as invalid has been simplified;
• the requirements for a survey regarding recognition of a trademark as well known in Ukraine have been eased;
• the requirements by which the personnel of the Appeals Chamber is formed have been supplemented;
• the procedure for exercising the powers of the Ukrainian IP Office in case of establishing the fact of the application of sanctions has been regulated.
